Nomadvans France Rental Terms for travel between 01-Jan-2010 and 31-Dec-2011 Please note: If you do not book in the local currency of the country where your rental takes place the payment due dates will change and
your main vehicle rental charges will be payable in full upon confirmation of your booking.
This is to lock in the currency rate of the day you booked on and avoid further currency fluctuations. Some charges like taxes,
compulsory fees, extra items may still be payable upon pick up of your vehicle in their local currency.
(Please note, If you book in the local currency of the country where your rental takes place the standard payment terms described under the heading Payment Terms will apply.)
Principle of use
The rental of a Nomadvans vehicle implicates acceptation, with no limit, of the general conditions defined here below. These are valid on January the 1st, 2009 and can be modified without notice.
Conditions to comply with for renting
The hirer shall supply on the date of departure the following elements :
- identity proof (valid ID or passport)
- exact present address
- valid driving licence, French or International, hold for at least 3 years (no copy or duplicata will be accepted) -The hirer must be aged 25 minimum.
- The non-respect of these conditions will lead to the immediate cancellation of contract, with no refund of any manner.
The hirer commits :
- not to allow anyone who has not been designated as a driver on the rental agreement to drive the vehicle
- to respect the number of passengers defined on the technical sheet of the vehicle (French “carte grise”)
- to use the vehicle only for its personal use
- not to sub-hire it to another party
- not to make paying transportation of people or material
- not to participate to any race, speed test, rallye or car competition
- not to use the vehicle for driving lessons
- not to modify the characteristics of the vehicle
- not to overload the vehicle above authorized weight
- not to tow any trailer or vehicle, neither use the rented vehicle to push another one
- not to leave the vehicle documents inside the vehicle when it is left empty of people
- to use the locking system as soon as the vehicle is left empty of people
- to respect the recommandations give by Nomadvans Ltd
- not to drive the vehicle under the influence of drugs or alcohol
- to declare within 48 hours any breakdown or accident
- not to give any wrong or false information to Nomadvans
- not to wilfully or recklessly damage the vehicle Bookings
Bookings are considered as definitive after payment of a 30% deposit with a minimum of 150 euros.
Cancellation
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
If cancellation occurs more than 33 days before departure date, the payments are refunded, after deduction of a 50 euros penalty.
If cancellation occurs less than 33 days before departure date, payments are not refunded.
A cancellation guaranty can be subscribed when booking (or, at least 33 days before departure). This guaranty covers the hirer until date of departure only for the following events :
Serious illness requiring that the hirer stays in bed
Illness non compatible with transportation by hirer’s own needs
Death of one of the van’s occupants or a close parent : husband / wife, father, mother, child, brother, sister
Designation as a Court jury member
Job loss
Pregnancy of one’s of the van’s
The origin of these events must not be prior to booking date, otherwise it will not be accepted by Nomadvans Ltd. Any cancellation made for one of the reasons mentioned here above must be reported to Nomadvans Ltd on written support five days after event occurs, together with all justifying documents : doctor certificate, death certificate ...
The cost of this guaranty is 5% of the total cost of rental.
In any case, the amount of this guaranty will never be refunded.
Nomadvans Ltd shall have the final word to consider if the event is valid for cancellation.
Renting period
During Spring holidays and high season, the minimum renting period is fixed to 1 week (7 days / 7 nights), this is to say from Saturday 5 pm to Saturday 10 am.
During medium and low seasons, the minimum renting period is 1 day (from Monday to Friday) and 2 days for week-ends (Saturday 11 am to Monday 9 am).
The length of contract is imperative.
In case of return of vehicle before the agreed return date, no refund will be made.
No extension of the renting period can be made without prior approval of Nomadvans Ltd. In case the hirer does not return the vehicle on agreed date, Nomadvans Ltd can undertake official procedures for vehicle stealing or confidence abuse.
Retun of vehicle must occur during opening hours of the company Nomadvans, the vehicle remaining under the responsability of hirer until return.
In case of return later than agreed date and time, a penalty of 150 euros will apply for each day.
The vehicle is supplied in roadworthy conditions, clean, with fuel and water tanks full, fitted with standard equipment. It shall be returned in the same state. Nomadvans Ltd provides equipment for inside cleaning that may be used by hirer when returning the vehicle.
The vehicle state is detailed in the inventory made on departure date. The hirer commits to check it and write down, before departure, any damage or loss that would not appear on the document. The hirer is liable for any damage not marked on the inventory and responsible for anything that happens to the campervan whilst under his care.
The hirer must maintain the water and oil levels as well as tyres pressure during the rental period.
Hirers will be fully accountable for, but not limited to the following:
Engine overheating, running out of oil, running out of cooling water, incorrect selection of gears resulting in damage to the gearbox, incorrect fuel put into vehicle, getting the vehicle bogged. Liability is total damage and expenses despite the excess amount listed on the rental agreement (excess relates to accident damage only).
It is the hirer’s responsability to deal with oil change when necessary and he will justify this by invoices, marking kilometers appearing on the counter during oil change.
The vehicle is rented with 2 gas bottles, one of them being full and the other in use. Any purchase of gas bottle will be supported by hirer.
The hirer will not allow any person(s) to smoke in the vehicle at any time. If any person(s) has smoked in the vehicle, it will be deemed to be soiled.
The non restitution of standard equipment will be billed 50 euros.
The non restitution of the radio player frontage will be billed 80 euros.
The non cleaning of vehicle or the non emptying of used water will be billed 70 euros.
The non full filling of fuel tank will be billed 80 euros.
In case of non restituion of optional material, the following fees will apply :

The cost of fuel during the rental period is supported by the hirer.
In case the hirer is unable to return the circulation documents of the van, the hirer will deal with all declarations necessary to have duplicata made, will support the cost of documents replacement and will pay Nomadvans Ltd the cost of van not being available for renting, on the basis of the rental tariff of the period.
Maintenance and repairs
The normal mechanical usury is on Nomadvans’ charge.
All mechanical repairs coming from unusual usury or carelessness of hirer will be on hirer’s charge.
In cas of damage or mechanical accident, whatever the importance is, the hirer shall contact Nomadvans Ltd with no delay and submit the vehicle to the opinion of a car specialist of the van brand and act as much as he can to prevent a worsening of the problem. If he does not act so, the hirer will be considered as personnally responsible.
In case the vehicle shall be immobilized, the repairings can only be made after written approval of Nomadvans Ltd and as per the company’s recommandations. The hirer will present the defective parts replaced and the invoices paid, addressed to Nomadvans name. They will be refunded to the hirer as long as the usury can be considered as normal and as long as the hirer has respected his obligations. In any case (vehicle breakdown, delay in van delivery ...), the hirer will be able to ask for compensation.
Insurance
The insurance described here below apply :
- in all countries mentioned on the green card
- during the period of van rental
- upon respect of conditions described in the present document
Only drivers validated by Nomadvans Ltd can be considered as covered within the insurance contract.
Our vehicles are proposed with a “multi-risk” insurance, with bond applying.
The insurance applies to the following risks :
Accidents
- Stealing and fire
Natural disasters
Window breakage
The vehicle contents are not insured, and the hirer is responsible for all damages within the vehicle, to accessories, tools, camping utensils, the standard equipment and any other special equipment, as well as tyres accidently damaged or van roof damages due to non respect of maximal height.
In case of accident caused by the hirer during which the van is seriously damaged or immobilised for 5 days or less, Nomadvans Ltd réserves the right to end the rental contract with no compensation nor refund. The costs of repairs or bond are still to be paid.
In the event of an accident or damage, if the hirer does not correctly complete a full insurance form, he may no longer be insured for that accident or damage. He further acknowledges that it is his responsibility to insure that he fills out a full insurance form where applicable.
In the event of an accident or damage involving a third party, if the hirer does not obtain the correct and full contact details of the additional party(s), he is liable for the excess amount of the insurance irrespective of who is at fault.
In the event of an accident or damage involving a third party, if it is not possible to obtain the excess amount of the insurance from that third party, the hirer is liable for the excess amount irrespective of who is at fault.
He acknowledges that the excess listed on the rental agreement will be processed in the case of any accident, irrespective of who is at fault. Reimbursement of the excess will occur where a 3 rd party is deemed at fault and repair costs have been recovered.
Where there is a cash excess, Nomadvans Ltd will bank the monies and the monies will be held by Nomadvans Ltd for a period of 21 calendar days from the date the vehicle is returned. He further acknowldeges that the monies will be returned to him in the form of a company cheque in euros and that he is responsible for correctly presenting the cheque to his financial institution and for any cost or charges incurred in the conversion of the cheque to another currency.
The non respect of conditions detailed in part 1 of this document will automatically lead to the cancellation of all forms of insurance and guarantees. The bond amount will no more be applicable and the hirer will be responsible for the whole damage in the conditions of his reliability.
Additional Driver
we don't charge additional drivers, but all the drivers must be aged 21 years or above, and have at least 3 years of driving licence.
Road Restriction
Our vans can be driven all over Western and Eastern Europe (25 countries) and Marocco.
Bond
A bond of 2.000 euros will be given (credit card print) by the hirer to Nomadvans Ltd so as to cover all amounts that the hirer may have to pay to Nomadvans Ltd at the end of the rental period.
This bond will be given back when van returns with a possible deduction of
Costs caused by hirer and not covered by insurance
Expenses such as described in part 5 of this document
Excess (security deposit)
Payment Terms
(a) Nomadvans Ltd will accept payment by credit cards, cheque (French only), or bank swift, approved by Nomadvans Ltd.(b) When payment is made by credit card, I agree that: (i) Nomadvans Ltd is irrevocably authorised to complete any documentation and to take any other action to recover from my credit card issuer all amounts due by me pursuant to this Agreement, including, but not limited to, any outstanding Rental Charges not paid to Nomadvans Ltd, any amounts due in respect of damage to the Vehicle or to property of a third party and all other additional charges as that are incurred (including all parking and traffic infringement penalties, road toll fines and associated administration costs); (ii) I will not dispute my liability to Nomadvans Ltd for any amount due under this Agreement and I shall indemnify and keep indemnified Nomadvans Ltd against any loss incurred (including legal costs) by reason of notifying my credit card issuer of such dispute. (iii) Nomadvans Ltd may process the credit card voucher. In the event that Nomadvans Ltd elects to accept payment of the Excess or Security Deposit by holding a signed and authorised open credit card voucher, I agree that Nomadvans Ltd is entitled to recover payment from my credit card issuer pursuant to paragraph (i) in respect of any amounts due which were not known at the time of return of the vehicle.
Terminating the agreement and repossession of the vehicle
I Acknowledge that Nomadvans Ltd may terminate this Agreement and repossess the vehicle (and for that purpose enter upon any premises and remove the Vehicle) at any time, without notification to me, and that I will pay the reasonable costs of repossessing the Vehicle, including towing charges if:
(a) I am in breach of any term of this Agreement
(b) I have obtained the Vehicle through fraud or misrepresentation;
(c) The Vehicle appears to be abandoned;
(d) The Vehicle is not returned on the agreed return date or Nomadvans Ltd reasonably believes that the Vehicle may not be returned on the agreed return date;
(e) Nomadvans Ltd considers, on reasonable grounds, that the safety of the passengers or the condition of the Vehicle is endangered. I understand that in the event of such termination or repossession, I have no right to a refund of any part of the rental charges.
(f) Nomadvans Ltd believes, on reasonable grounds, that payment for any Rental Charges associated with the hire have not been paid to Nomadvans Ltd, or will not be paid to Nomadvans Ltd

Change of vehicle
Nomadvans Ltd reserves the right at its absolute discretion to substitute a comparable or superior vehicle. In that event, the hirer shall not be liable for any increased rental or other charges save for any additional running costs pertaining to the substitute vehicle. Such substitution shall not entitle the hirer to any refund and does not constitute a breach of this Agreement.
Animals
No animals are permitted in vehicles, excluding guide dogs.
Smoking
Smoking is not allowed in our vehicles.
Road Restriction
Our van can be drivern into all over Western and Eastern Europe (25 countries) and Marocc.
Conditions of the agreement
This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this Agreement. Nomadvans Ltd reserves the right to add or amend any rental charges without prior notice. Proper law
This Agreement shall be governed by the law of France and the Court of Bayonne will only be relevant.

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
